Sheriff sales are scheduled on Thursdays beginning at 10:00 a.m. and held at the East door of the courthouse (outside of the Clerk of Court’s office).
Notifications of these sales are published in The West Bend News for three consecutive weeks before the sale. All sales will have a second tentative sale date to be conducted in the event there is no sale on the first date.
At the first scheduled sale, bidding starts at 2/3 of the appraised value with the highest bidder* required to pay a ten percent deposit the day of the sale. Second sale dates will not have a minimum starting bid (see below regarding tax sales). However, at either sale, purchasers are responsible for any costs, allowance and taxes insufficient to be covered by the proceeds of the sale. All appraisals are done without an interior inspection and neither the Sheriff’s Office nor the appraisers are responsible for the condition of the property at the time the purchaser takes possession.
*Lending institutions shall have their attorney submit recording costs and conveyance fees when their deed and conveyance form is forwarded to the Sheriff’s Office for recording and will not be required to pay a deposit at the time of the sale. The Sheriff’s deed fee of $50 may be included in the same check as the $75.00 recording fee.
Attorneys need to file an approval form along with the Complaint/Praecipes for Order of Sale for the legal description of real estate. Please click here for this form. All purchasers are required to file a Purchaser’s Information form at the time of sale. Please click here for this form to be completed prior to the sale.
The highest bidder has 30 days from the sale date to obtain an examination of title at their expense, if they desire one. If said examination determines the title to be unmarketable, by reason of any defect in the Court proceedings or the existence of any outstanding interest rendering the title unmarketable, the purchaser may, within the 30 day period, file a written motion requesting that the sale be set aside. If the Court finds the title is unmarketable, the Court will refuse to confirm the sale or fix a reasonable time, not to exceed 90 days, within which the defect of title may be corrected.
Once the sale is confirmed through a Judgment Entry of the Court, a deed is prepared and recorded upon receipt of the full purchase price and recording fees. The Sheriff’s Office will distribute the purchase price as ordered by the Court which includes court costs, pro-rated taxes, deed and recording fees and other necessary expenses. The Sheriff’s Office will record the deed and the recorded document will be forwarded to the purchaser. Recording costs will be taken from the 10% deposit with the remaining monies put towards the purchase price (exception being to lending institutions as noted above).
Tax sales are also held on Thursdays at the same location. There are no appraisals for tax sales and bidding starts at an amount to cover delinquent taxes, deed fee, title search, court costs, etc. Two dates are scheduled for tax sales so that if the property does not sell on the first date, it is offered again on the second date. Payment in full is due on the day of the sale.
The Sheriff’s Office does not have keys to any of these properties.
